Sale prices and purchase modalities

All the sale prices of the services exposed and indicated inside the website, for which they constitute an offer to the public according to the art. 1336 c.c., are included of V.A.T

In the phase of purchase will be added the tax and the eventual expenses of transport.

Obligations of the buyer

The consumer is committed and obliged, once the purchase procedure "on-line", to provide for the printing and storage of these general conditions, which, however, will have already viewed and accepted as a necessary step in the purchase, as well as the specifications of the product purchased, and this in order to fully satisfy the condition referred to in art. it is made strict prohibition to the purchaser to insert false data, and/or invented, and/or of fantasy, in the procedure of recording necessary to activate in its comparisons the iter for the execution of the present contract and the relative ulterior communications; the personal data and the e-mail must be exclusively the own real personal data and not of third persons, or of fantasy. It is expressly forbidden to make double entries corresponding to a single person or enter data of third parties. Elettrotecnica Agostini & C. SRL reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.

Right of withdrawal and complaints

The consumer who for any reason is not satisfied with the purchase made, has the right to terminate the contract without penalty within 14 consecutive days from receipt of goods. The withdrawal must be manifested by sending in the aforementioned period of 14 calendar days, a registered letter with acknowledgment of receipt, to the following address: ELECTROTECHNICS AGOSTINI & C. Within the same period can be sent a telegram or fax which must be followed within 48 hours the above letter with acknowledgment of receipt to confirm the manifest withdrawal. The consumer cannot exercise this right of withdrawal for products made to measure or clearly personalized or which, by their nature, can not be returned or are liable to deteriorate or expire rapidly. Within the aforementioned term of 14 calendar days must be returned to the sender-supplier all the goods purchased intact and in their original packaging complete with any manuals and instruction booklets, without any lack. The restitution expenses will be charged to the customer. Once the goods have been received and the necessary checks have been carried out, ELETTROTECNICA AGOSTINI & C. SRL will provide for the forwarding of the entire amount paid by the consumer within thirty days, transport costs excluded, with bank value date in any case not higher than the fifteenth working day from the date of receipt of the returned goods. It will be cure of the consumer to timely supply the banking coordinates on which to obtain the credit transfer

(full IBAN, name and address of the bank and name of the account holder).

Contractual termination and Express Resolutive Clause

ELECTROTECHNICS AGOSTINI & C. SRL has the right to terminate the contract by giving simple notice to the customer with adequate and justified reasons, in which case the customer will be entitled only to a refund of any amount already taken and paid.

Jurisdiction and competent court

Any dispute concerning the application, execution, interpretation and violation of the purchase contracts stipulated "on-line" through the site of ELETTROTECNICA AGOSTINI & C. SRL is subject to Italian jurisdiction; these general conditions refer, for anything not expressly provided for therein, to the combined provisions of Legislative Decree No. 50 of 15.1.1992 and Legislative Decree No. 185 of 22.5.1999. Any dispute between the parties regarding this contract shall be settled by the Court of PISTOIA.

ELECTROTECHNICS AGOSTINI & C. SRL is exonerated from any liability in the event that the order was received by children under 18 years.

Responsibility in the shipment of goods

In the event that, upon delivery by the courier of the package / package, the packaging of the goods are not intact but had imperfections, please report it on the same reserve at the time of withdrawal, otherwise it will not be recognized claim.

Guarantee of the goods

For purchases between companies, purchase with an invoice made out to a company holding a VAT number, reference is made to the Italian Civil Code, which in the fourth book (of obligations) title III (of individual contracts) defines the end user buyer as "buyer".

The art. 1490 c.c. regulates the guarantee of the vendor for the defects of the thing sold, and the art. 1495 c.c. defines the terms of guarantee of the duration of 1 year from the delivery of the good.

Therefore, the purchase with an invoice made out to a company holding a VAT number entitles the "buyer" end user, to one year warranty on all products, and the reference legislation is the Italian Civil Code, while the purchase with a receipt, fiscal receipt or invoice made out to the customer holding only the tax code entitles the "consumer" end user, to 2 years warranty on all products, and the reference legislation is the Consumer Code.

Replacement of goods under warranty

In the event of hidden manufacturing defects, the customer will be entitled to the replacement of the goods.

The replacement under warranty of the material will take place only after a technical verification by the company Elettrotecnica Agostini & C srl.

In the case of materials not produced by us, the replacement will take place only if authorized by the manufacturer.

The return of goods must be agreed in advance with our sales department, otherwise it will not be accepted.

The returned goods must be in the original packaging and must be intact.

The goods must arrive free port at the expense of the sender (unless our proven error) and perfectly packaged.
